ACKNOWLEDGEMENT AND INDEMNITY FOR TEST DRIVE

Herein after referred to as "the Test Driver"
  1. Have been made aware of the full terms and conditions, and my consent to all the terms and conditions is provided of my own free will without any undue influence from any person whatsoever.
  1. 1. I, the Test Driver, consent and acknowledged to the following terms and conditions.
    1. a. I have a valid driver's license to operate the above-mentioned motorcycle;
    2. b. I presently have in effect the respective motor vehicle/motorcycle insurance that meets or exceeds the minimum requirements and applies to the vehicle during the time that is in my possession or under my control;
    3. c. I will not permit any other person to operate this vehicle;
    4. d. I have personally inspected the vehicle and have notified the dealership of all and any damage to the vehicle before taking possession of the vehicle and furthermore shall return the vehicle in the same condition as I receive it;
    5. e. I will immediately notify the dealership of any damage, accident, theft or vandalism involving the vehicle to the police, the dealership and my insurance company;
    6. f. I will be liable for any damage to the vehicle and/or property arising out of my use, possession or control of the vehicle, including injury, negligence and/or death; and
    7. g. In the event of an accident or any damage to the vehicle and/or property arising out of my use, possession or control, I consent to reimburse the dealership for the full damages and/or expenses incurred;
  2. 2. I, the Test Driver, acknowledge that:
    1. a. I am liable for any loss or damage to the vehicle that occurs while the vehicle is in my possession or control, plus the dealership's related expenses;
    2. b. I will not hold the dealership, or its agents liable for any losses, liabilities, injuries, claims, demands, costs, expenses, and/or damages arising out of my use, possession or control of the vehicle, including injury, negligence or death;
    3. c. The dealership will not be held liable for any loss;
  3. 3. Breach
    Should the Test Driver fail to adhere to or breach any and/or all the above terms and conditions or obligations, the Test Driver agrees to be held liable for all those costs and expenses, including legal costs incurred. Furthermore, the Test Driver consents to the jurisdiction of the High Court of South Africa in the case of legal proceedings and consents to be liable for all and any expenses incurred as a result of such legal proceedings.
  1. Disclaimer
    Unless prohibited by law, you agree to hold the dealership, its employees, agents and/or it's representatives harmless for any loss or damage caused to the Test Driver or any third party arising from the service provided by the dealership, their agents and/or employees for any reason, including negligence (including gross negligence).
